Refund policy

1. Definitions

“Seller” means Mercury Security Distribution.
“Buyer” means any business purchasing goods from the Seller.
“Goods” means any products supplied by the Seller to the Buyer.
“RMA” means Return Material Authorisation issued by the Seller.


2. General Principles

2.1. These Returns Terms & Conditions apply to all B2B sales made by the Seller unless otherwise agreed in writing.
2.2. The Buyer acknowledges that B2B sales are not subject to consumer cooling-off rights, and returns are only permitted in accordance with these terms.


3. Return Eligibility

3.1. Goods may only be returned with a valid RMA issued by the Seller.
3.2. To request an RMA, the Buyer must submit a written request to the Seller.
3.3. The Seller reserves the right to reject any return request that does not comply with these terms.
3.4. Goods must be returned in:

  • Original, unopened packaging.
  • Unused condition.
  • Suitable transport packaging to avoid damage in transit.

4. Non-Returnable Goods

The following items cannot be returned unless defective:
a. Custom-made or special-order items;
b. Time-sensitive goods;
c. Goods altered, installed, or used by the Buyer;
d. Goods not in original packaging.


5. Return Procedure

5.1. The Buyer must not return any Goods without receiving an RMA number.
5.2. All returns must include the RMA number clearly marked on the packaging.
5.3. The Buyer is responsible for shipping costs and risk during transit, except in cases where the Seller agrees in writing to cover return shipping for defective or incorrect Goods.
5.4. Returned Goods must be delivered to the Seller’s designated returns address.


6. Inspection and Refunds

6.1. All returned Goods will be inspected by the Seller upon receipt.
6.2. Refunds, credit notes, repairs, or replacements will only be issued after the Seller confirms that the Goods meet the return criteria.
6.3. The Seller will notify the Buyer of the result of the inspection.
6.4. Refunds will be issued via the original payment method unless otherwise agreed.


7. Defective or Non-Conforming Goods

7.1. The Buyer must notify the Seller if Goods are defective, damaged, or not in conformity with the order.
7.2. Upon verification, the Seller may, at its discretion:

  • Repair the Goods.
  • Replace the Goods.
  • Issue a refund.
  • Issue a credit note.


8. Title and Risk

8.1. Risk passes to the Buyer upon delivery of the Goods.
8.2. Risk for returned Goods passes back to the Seller only once the Seller receives them.
8.3. Title to returned Goods transfers to the Seller once any refund or replacement is issued.


9. Limitation of Liability

9.1. The Seller’s maximum liability relating to returned Goods is limited to the price paid for those Goods.
9.2. The Seller is not liable for loss of profit, loss of business, or any indirect or consequential damages arising from returned or defective Goods.


 

10. Variation of Terms

10.1. Mercury Security Distribution reserves the right to amend these Returns Terms & Conditions at any time.
10.2. The applicable version is the version in force at the time an order is placed.
